These Terms of Service ("Terms") govern your use of the website at bluewhalepoolspa.com and any pool and spa services provided by Blue Whale Pool & Spa ("Blue Whale," "we," "us," or "our"), a pool service company operating in San Antonio, Texas and surrounding areas.

By using this website, requesting a quote, subscribing to our text messaging program, or engaging our services, you agree to these Terms. If you do not agree, please do not use the site or our services.

Our Services

Blue Whale Pool & Spa provides residential and commercial pool and spa services, including:

• Weekly and recurring cleaning and chemical maintenance
• Equipment repair — pumps, filters, heaters, automation, and leak detection
• Pool and spa remodeling and renovation
• Commercial and HOA account servicing
• Pre-purchase pool and spa inspections for prospective homebuyers

Service scope, frequency, and pricing are set out in the written quote or service agreement you receive. That document controls if it conflicts with anything on this website.

Quotes and Estimates

Quotes are estimates based on the information you provide and, where applicable, an on-site assessment. Pricing may change if conditions differ materially from what was described — for example, undisclosed equipment damage, pool size, or water condition.

We will notify you and obtain your approval before performing work that exceeds an approved estimate.

Scheduling and Property Access

Recurring service is performed on a regular route day. Weather, equipment failures, and safety conditions may shift a visit; we will make reasonable efforts to notify you.

You agree to provide safe, unobstructed access to the pool area on scheduled service days, including gate codes or keys where needed, and to secure pets. If we cannot access the pool, the visit may be billed as completed.

Payment Terms

Recurring service is billed monthly unless your agreement states otherwise. Repair and renovation work may require a deposit before materials are ordered.

Invoices are due on the terms stated on the invoice. Accounts significantly past due may be suspended until the balance is settled.

Cancellation

Either party may cancel recurring service with reasonable written notice. You remain responsible for services already performed and for any materials or equipment already ordered on your behalf.

Content on this site — text, images, video, and design — is owned by Blue Whale Pool & Spa or used with permission, and may not be copied or reused commercially without written consent.

You agree not to use this site to submit false information, attempt unauthorized access, or interfere with its operation.

We do not buy, sell, rent, or trade leads or contact lists, and we do not operate or participate in any affiliate or lead-resale program.

Warranties and Disclaimers

We stand behind our workmanship. If equipment fails as a direct result of our service error, we will repair or replace it.

Except as expressly stated in your written service agreement, services and website content are provided "as is." We disclaim implied warranties of merchantability and fitness for a particular purpose to the fullest extent permitted by Texas law. Manufacturer warranties on parts and equipment are provided by the manufacturer, not by Blue Whale.

Pool and spa water chemistry is affected by weather, bather load, and equipment condition. We do not guarantee specific water conditions between scheduled visits.

Limitation of Liability

To the fullest extent permitted by law, Blue Whale Pool & Spa is not liable for indirect, incidental, or consequential damages arising from our services or your use of this website. Our total liability for any claim will not exceed the amount you paid us for the service giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under Texas law.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Bexar County, Texas.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website or services after a change constitutes acceptance of the revised Terms.
